How sick leave interacts with RTO mandates
Paid sick leave is a state-level matter (plus a handful of cities). In roughly a dozen states and many localities, employees earn paid sick leave that can generally be used for the employee's own health, and — in most of those — for a family member. A legitimate sick day is normally a protected absence regardless of office-day rules: the office policy governs where you work, not whether you're too sick to work.
- Own illness: almost always a valid sick-leave use where paid sick leave exists.
- Child ill / school closed: valid in most (not all) sick-leave states — this is often called "safe time" or family-care use.
- Routine appointments: depends on the state and employer policy; many cover preventive and routine care.
- Exposure / quarantine: often covered by sick leave or, for serious conditions, by FMLA-type leave; check state rules.
Frequently asked questions
Can my employer discipline me for calling in sick on an office day?
If you use accrued paid sick leave properly, that absence is generally protected in states with sick leave laws — the office mandate doesn't override it. If your state has no sick leave law, employers generally set the attendance rules, and sick days may be unpaid or discretionary. Check your state's entry above.
Does sick leave cover my child's illness?
In most states with paid sick leave laws, yes — sick leave can usually be used to care for a child, spouse or parent (some extend to broader household members). Coverage varies, so the state summary above matters.
Do I need a doctor's note?
Many state sick leave laws limit or prohibit employer demands for doctor's notes for ordinary illness, especially for short absences. If your employer insists on one, ask on what policy basis — and keep documentation yourself.
What's the difference between sick leave and FMLA?
Paid sick leave is short-term (days), state-level, usually accruing per hours worked. FMLA is federal, unpaid, job-protected leave for qualifying serious health conditions, typically after 12 months on the job. They can stack: a serious condition may be FMLA leave, paid for with accrued sick days.
